Definition of the Family and Medical Leave Act (FMLA) and the California Family Right Act (CFRA)

 

FMLA is based on a Federal law and is administered by the U.S. Department of Labor (DOL), Employment Standards Administration, Wage and Hour Division.

 

CFRA is a state law, which is administered by the Department of Fair Employment and Housing (DFEH). State legislation in
1993 changed the state law to generally conform to the provisions of the FMLA.

 

FMLA/CFRA does not supersede any memoranda of understanding that
provides greater family or medical leave rights.
