Employer Responsibilities


Covered employers must inform employees requesting leave whether they are eligible under FMLA. If they are, the notice must specify any additional information required as well as the employees’ rights and responsibilities. If they are not eligible, the employer must provide a reason for the ineligibility.


Covered employers must inform employees if leave will be designated as FMLA-protected and the amount of leave  counted against the employee’s leave entitlement. If the employer determines that the leave is not FMLA protected,
the employer must notify the employee.

고용주로서 회사는 FMLA가 가능한지 employee에게 알려 주어야 하며 합니다. 그러면 다시 또 employee는 개인적인 상태로 FMLA가 가능한지 의사의 진단서로 회사에 알려주어 상호 해야 되는 부분들을 잘 이행하면 좋을것 같습니다. 회사는 만약에 회사의 조건에 해당되지 않을 경우에는 employee에게 왜 안되는지 그 원인을 밝혀 주어야 합니다.

Unlawful Acts by Employers

FMLA makes it unlawful for any employer to:
•    Interfere with, restrain, or deny the exercise of any right provided under FMLA;
•    Discharge or discriminate against any person for opposing any practice made unlawful by FMLA or for involvement in any proceeding under or relating to FMLA.
