혹시 employee로 Hire할 경우, Payroll Tax를 save하기 위한 방법으로 1099를 끊어주는 independent contractor 로 계약하시는 경우가 있다면, 아래 조항을 유의하셔야 하겠습니다.

 

Independent Contractor로 계약을 하시려면, 그에 해당하는  자격이 있어야 합니다. 이에 대한 자격이 없어 Employee로 Hire해야 하는데도 불구하고 Independent Contractor로 계약하시고 계시다면, 위반입니다. 이에대한 Penalty 조항도 아래와 같이 부과하고 있습니다.

 

SB 459: Penalties for employers who misclassify employees as independent contractors.

  • It is unlawful to willfully misclassify an individual as an independent contractor.
  • It is unlawful to charge a misclassified independent contractor fee or make any deductions from compensation for any purpose including for goods, materials, space rental, services, government licenses, repairs, equipment maintenance or fines.
  • Each violation has a fine of $5,000-$10,000.
  • If there is a pattern of such violations the fines could raise to between $10,000-$25,000.
